Klamath and Mateel Issue 60 Day Notice for Prop 65 Violation
Klamath Environmental Law Center (“Klamath”) and the Mateel Environmental Justice Foundation (“Mateel”) issued a 60 day notice of intent to sue American Valve, Inc., Fluidmaster, Inc., Gross Mechanical Laboratories, Inc., Midland Metal, Orchard Supply Hardware LLC, and West Marine, Inc.
Klamath and Mateel contend that these companies have violated Proposition 65 when California residents have come into contact with their products, specifically brass plumbing accessories, fittings, valves, hoses, connectors, and tubes. The brass used to make these products is allegedly leaded brass, which contains lead and lead compounds, which are known to the state of California to cause cancer, birth defects, and other reproductive harm.
California residents are exposed to lead, without warning, when they handle these brass accessories. Lead is consequently absorbed through their skin, taken into cuts and abrasions, absorbed through mucous membranes, and ingested or inhaled via hand to mouth contact.
