More Prop. 65 Actions Slam the Food Industry

The implementation of Proposition 65 warnings in numerous Starbucks stores across California this year has served as a visual demonstration of Prop. 65 finally penetrating the food industry. These warnings in the world’s leading coffee chain specifically caution consumers of acrylamide, a chemical known to the State of California to cause cancer or reproductive toxicity. Acrylamide results from cooking, such as by roasting coffee beans or baking baked goods, and has been the focus of many new lawsuits targeting the food industry.

The environmental organization, Environmental Law Foundation (ELF), recently slammed 50 to 100 companies with letters claiming that they failed to provide “clear and reasonable warnings” that their products contain acrylamide. ELF has offered the companies a chance to opt in to a settlement, or to decline and consequently face a new enforcement action.
